These Terms & Conditions (“Terms”) govern the use of the Grails Exotics website and the rental of vehicles offered through Grails Exotics, a brand operated by DADE GRAILS LLC (“Grails Exotics,” “we,” “us,” or “our”).
By submitting a reservation request, booking a vehicle, signing a rental agreement, or renting a vehicle from Grails Exotics, you acknowledge that you have read, understood, and agreed to these Terms.
1. Eligibility
To rent a vehicle from Grails Exotics, a renter must:
- Meet the minimum age requirement applicable to the vehicle being rented.
- Possess a valid driver’s license.
- Provide valid identification and any documentation requested by Grails Exotics.
- Satisfy Grails Exotics’ verification and approval requirements.
- Provide proof of insurance when required.
- Meet any additional requirements specified for a particular vehicle.
Meeting the minimum requirements does not guarantee approval. Grails Exotics reserves the right to approve or decline any rental request at its discretion.
Minimum age requirements, insurance requirements, deposits, and other rental requirements may vary by vehicle.
2. Reservation Requests
Submitting a reservation request through the website does not guarantee a reservation.
A reservation becomes confirmed only after Grails Exotics has reviewed and approved the request and provided confirmation to the renter.
Grails Exotics may decline a reservation request for any lawful reason, including availability, renter qualifications, insurance requirements, vehicle requirements, or other business considerations.
3. Reservation Deposit
A reservation deposit may be required to secure an advance reservation. The amount, if applicable, will be communicated at the time of booking. Any reservation deposit paid is applied toward the total refundable security deposit, so only the remaining balance of the security deposit is due at pickup. Same-day rentals may not require a reservation deposit.
4. Security Deposit
A refundable security deposit may be required before the vehicle is released to the renter.
The amount of the security deposit may vary depending on the vehicle, rental duration, renter, and other circumstances.
The security deposit may be used to cover amounts owed by the renter, including but not limited to:
- Vehicle damage
- Excessive cleaning
- Lost or damaged keys
- Missing vehicle equipment
- Fuel charges
- Tolls
- Parking charges
- Traffic violations
- Late-return charges
- Unauthorized use
- Other amounts permitted under the rental agreement
Any remaining eligible security-deposit balance will be returned after the vehicle has been inspected and outstanding charges have been determined.
5. Rental Agreement
Before taking possession of a vehicle, the renter may be required to sign a separate vehicle rental agreement.
The vehicle-specific rental agreement may contain additional terms relating to:
- Rental dates and times
- Authorized drivers
- Mileage
- Insurance
- Security deposits
- Vehicle condition
- Permitted use
- Damage responsibilities
- Late returns
- Cancellation
- Additional fees
If the vehicle-specific rental agreement contains terms that are more specific than these website Terms, the vehicle-specific rental agreement will control with respect to that rental.
6. Authorized Drivers
Only drivers who have been approved by Grails Exotics and identified in the applicable rental agreement may operate the vehicle.
The renter may not allow another person to operate the vehicle without prior approval from Grails Exotics.
The renter is responsible for the actions of any authorized driver during the rental period.
7. Vehicle Use
Rented vehicles must be operated responsibly and in compliance with all applicable laws.
Unless expressly authorized in writing, the following are prohibited:
- Racing or track use
- Drag racing
- Speed contests
- Reckless driving
- Drifting
- Burnouts
- Launch-control abuse
- Off-road use
- Driving under the influence of alcohol or drugs
- Commercial use
- Rideshare or delivery use
- Subleasing or re-renting the vehicle
- Allowing unauthorized drivers to operate the vehicle
- Any illegal activity
- Any use that may damage the vehicle
Grails Exotics may impose additional vehicle-specific restrictions.
8. Mileage
Mileage allowances may vary by vehicle and rental agreement.
Any mileage included with a rental will be specified during the booking process or in the applicable rental agreement.
Additional mileage charges may apply when the renter exceeds the permitted mileage.
9. Vehicle Condition
The renter is responsible for returning the vehicle in substantially the same condition in which it was provided, subject to ordinary wear and tear.
Grails Exotics may document the vehicle’s condition through photographs or video before and after a rental.
The renter should inspect the vehicle before accepting it and report any pre-existing damage or concerns before departure.
Failure to report previously existing damage may make it more difficult to establish that the damage existed before the rental.
10. Damage
The renter may be financially responsible for damage occurring during the rental period to the extent permitted by applicable law and the applicable rental agreement.
This may include damage resulting from:
- Collision
- Scraping
- Curb or wheel damage
- Tire damage
- Interior damage
- Mechanical abuse
- Improper operation
- Negligence
- Unauthorized use
- Acts of an unauthorized driver
Grails Exotics may use photographs, video, inspection reports, repair estimates, invoices, or other documentation when evaluating damage.
11. Accidents
The renter must immediately notify Grails Exotics of any accident, collision, theft, vandalism, or significant damage involving a rental vehicle.
The renter must also contact law enforcement and emergency services when required by law or reasonably necessary.
The renter must cooperate with Grails Exotics and any applicable insurance company regarding claims and investigations.
The renter must not admit liability, settle a claim, or make representations on behalf of Grails Exotics without authorization.
12. Insurance
Insurance requirements vary by vehicle and rental.
Grails Exotics may require renters to provide proof of valid insurance or obtain applicable rental coverage before the vehicle is released.
The renter is responsible for complying with all insurance requirements communicated before or during the rental.
Providing proof of insurance does not necessarily mean that the renter has satisfied all applicable coverage requirements.
13. Fuel
Vehicles will generally be provided with a specified fuel level and should be returned at the same level unless otherwise stated in the rental agreement.
A refueling charge may apply if the vehicle is returned with less fuel than required.
14. Late Returns
Vehicles must be returned at the agreed-upon date and time.
Late returns may result in additional rental charges, fees, or other consequences specified in the applicable rental agreement.
If a renter expects to be late, they should contact Grails Exotics as soon as possible.
Extending a rental is not guaranteed and is subject to vehicle availability and approval.
15. Cancellation
Cancellation terms may vary depending on the reservation and vehicle.
Any applicable cancellation policy will be communicated to the renter before or at the time the reservation is confirmed.
Failure to appear for a scheduled rental may be treated as a cancellation or no-show and may result in forfeiture of applicable deposits or charges.
16. Vehicle Availability
Grails Exotics makes reasonable efforts to provide the reserved vehicle.
However, circumstances such as mechanical issues, accidents, maintenance, damage, recalls, or other unforeseen events may make a vehicle unavailable.
If the reserved vehicle becomes unavailable, Grails Exotics may, when reasonably possible, offer an alternative vehicle, reschedule the rental, or provide another appropriate resolution.
17. Pickup and Delivery
Pickup and delivery procedures, locations, fees, and requirements may vary by rental.
The renter must provide accurate information regarding the requested pickup or delivery location.
Additional delivery or pickup fees may apply depending on the location.
18. Tolls, Tickets, and Other Charges
The renter is responsible for charges incurred during the rental period, including applicable:
- Tolls
- Parking fees
- Traffic citations
- Red-light or camera citations
- Impound fees
- Towing charges
- Administrative fees
- Other charges resulting from the renter’s use of the vehicle
19. Prohibited Conduct
The renter may not:
- Modify the vehicle
- Remove vehicle components or equipment
- Tamper with safety or tracking equipment
- Smoke or vape in the vehicle when prohibited
- Transport prohibited substances or illegal items
- Use the vehicle for unlawful purposes
- Attempt to conceal damage
- Provide false information
- Provide fraudulent documents
- Allow unauthorized persons to operate the vehicle
Violation of these restrictions may result in termination of the rental and additional charges as permitted by the rental agreement and applicable law.
20. Termination of Rental
Grails Exotics may terminate a rental when permitted by law and the applicable rental agreement, including circumstances involving:
- Unauthorized use
- False or fraudulent information
- Unsafe operation
- Nonpayment
- Material violation of the rental agreement
- Use of the vehicle for unlawful purposes
Upon termination, the renter must promptly return the vehicle as instructed.
21. Privacy
Information submitted through the Grails Exotics website or rental process may be collected and used for purposes including reservation processing, identity verification, communication, insurance verification, payment processing, fraud prevention, and rental administration.

22. Website Information
Grails Exotics makes reasonable efforts to keep website information accurate and current. However, vehicle availability, pricing, specifications, images, and other information may change without notice.
Website photographs are intended to represent the vehicles but may not show the exact condition of a vehicle at the time of rental.
23. Pricing
Rental prices, deposits, mileage allowances, delivery fees, and other charges may vary by vehicle and rental.
The applicable price and charges will be communicated before a reservation is finalized.
24. Right to Modify Rental Requirements
Grails Exotics reserves the right to establish or modify rental requirements, including age requirements, insurance requirements, deposits, mileage limits, vehicle-specific requirements, and approval criteria.
Any such requirements applicable to a particular reservation will be communicated to the renter.
25. No Guarantee of Rental Approval
Submission of information, possession of a valid driver’s license, meeting the minimum age requirement, or having insurance does not guarantee rental approval.
Grails Exotics retains discretion to approve or decline rental requests, subject to applicable law.
26. Limitation of Liability
To the maximum extent permitted by applicable law, Grails Exotics and DADE GRAILS LLC will not be responsible for indirect, incidental, consequential, or other damages arising from a rental or website use except where such limitation is prohibited by law.
Nothing in these Terms is intended to waive or limit any rights or responsibilities that cannot legally be waived or limited.
27. Indemnification
To the extent permitted by applicable law, the renter agrees to be responsible for losses, claims, damages, fines, penalties, or expenses arising from the renter’s violation of the rental agreement, misuse of a vehicle, or violation of applicable law.
28. Governing Law
These Terms are governed by the laws of the State of Florida, except to the extent otherwise required by applicable law.
Any disputes will be handled in accordance with the applicable rental agreement and Florida law.
29. Changes to These Terms
Grails Exotics may update these Terms from time to time.
The current version will be posted on the website with the applicable “Last Updated” date.
The Terms applicable to a particular rental are those agreed to by the renter in connection with that rental.
30. Florida Motor Vehicle and Insurance Requirements
Grails Exotics operates its rental business in accordance with applicable Florida motor vehicle and insurance requirements, including Florida Statutes §§ 324.021 and 627.7263, as applicable to the rental transaction.
